LAVENDER U-PICK TERMS, RELEASE OF LIABILITY & PROPERTY RULES

By purchasing a ticket, entering the property, or participating in lavender cutting activities at Araceli Farms LLC (“Araceli Farms”), purchaser and all guests agree to the following terms:

TICKET TERMS

* Each ticket is valid only for the date and time purchased unless otherwise stated.
* Tickets are **final sale**. No refunds, exchanges, credits, or rescheduling.
* Late arrivals may result in reduced participation time.
* Araceli Farms may delay, modify, reschedule, or cancel activities due to unsafe weather, crop conditions, farm operations, emergencies, or circumstances beyond its control.

ACTIVE FARM PROPERTY NOTICE

Araceli Farms is a working agricultural property with natural and changing rural conditions. Guests understand the property may include uneven terrain, irrigation systems, dirt roads, gravel, mud, insects, weather exposure, agricultural materials, and other conditions not found in urban or indoor environments.

TOOL USE NOTICE

Guests may be provided scissors, snips, or cutting tools for harvesting lavender. Use of tools is voluntary and at guest’s own risk.

Guests agree to:

* Use tools carefully and only for intended purpose
* Keep blades pointed away from self and others
* Never run, play, or horseplay while holding tools
* Return tools after use if provided by Araceli Farms
* Keep tools out of reach of children

Children may not use cutting tools unless directly supervised and expressly permitted by Araceli Farms.

ASSUMPTION OF RISK

I voluntarily assume all risks associated with entering and participating in lavender harvesting activities, including but not limited to:

* Cuts, punctures, scrapes, or injury from scissors or tools
* Uneven ground, holes, slopes, mud, gravel, rocks, roots, or natural terrain
* Irrigation lines, hoses, valves, or farming infrastructure
* Bees, insects, wildlife, pollen, dust, or allergens
* Heat, dehydration, sun exposure, wind, rain, or changing weather
* Slips, trips, falls, collisions, or property damage
* Contact with plants, stems, branches, thorns, or agricultural debris
* Actions of other guests, children, or third parties

RELEASE OF LIABILITY

To the fullest extent permitted under California law, I release and discharge Araceli Farms LLC, its owners, members, managers, employees, contractors, volunteers, agents, landowners, affiliates, and representatives from claims for injury, illness, death, loss, theft, or property damage arising from my presence on the property or participation in U-pick activities, except where caused by gross negligence or willful misconduct.

PROPERTY RULES

All guests agree to the following:

* Stay in designated guest areas only
* Harvest only from approved rows or areas
* Follow staff harvesting instructions
* Do not damage plants, irrigation, signs, fencing, or farm infrastructure
* Do not climb fences, structures, equipment, or displays
* No throwing lavender, tools, rocks, or debris
* No smoking, open flames, or illegal substances
* No drones without written approval
* No pets unless approved in advance
* Respect staff, other guests, and the land
* Follow all staff directions immediately

Violation of rules may result in immediate removal without refund.

CHILDREN / MINORS

Parents or guardians are solely responsible for supervising minors at all times. Children may not roam unattended.

Parents/guardians are fully responsible for any child using tools or entering harvesting areas.

DAMAGE RESPONSIBILITY

Purchaser agrees to be financially responsible for damage caused by themselves, their guests, children, or misuse of tools.

PHOTO / VIDEO RELEASE

I understand Araceli Farms may capture incidental photos or video of the property during business operations. I grant permission for my likeness to appear incidentally in promotional materials unless otherwise requested in writing before arrival.

MEDICAL CARE

Araceli Farms has no duty to provide medical personnel or transportation. In the event of emergency, I authorize emergency assistance and accept responsibility for resulting costs.

GOVERNING LAW

This agreement shall be governed by the laws of the State of California. If any provision is unenforceable, the remaining provisions remain in effect.

ACKNOWLEDGMENT

I have read and understand these terms. I voluntarily agree to them and understand I am waiving certain legal rights.
